Notice of Intention to Sell land

Wodonga City Council (Council) gives notice under Section 114 of the Local Government Act 2020 (Act) that it intends to sell the land described below (Proposal).

The land which is the subject of the Proposal is an area of 2.05 ha identified on the plan below, being part of the land contained in certificate of title volume 12370 folio 060, and located at part Roche Drive, Barnawartha North, Victoria 3691 (Land).

The Proposal is that the Land be sold by private treaty to Hydroxy Systems Australia Pty Ltd and/or nominee, on the following key terms:

a. a purchase price of $1,400,000 plus GST;

b. payment of a deposit equal to 5% of the price;

c. settlement will be due on the later of 30 days after the grant of the Permit and registration of a plan of subdivision;

d. the sale will be conditional on the purchaser procuring a planning permit to develop the Land as a waste plastics recycling facility (Permit), within 6 months after the day of sale; and

e. as a condition of sale, the purchaser must enter into an agreement with Council pursuant to section 173 of the Planning and Environment Act 1987, which requires the purchaser to:

i. develop the Land in accordance with the Permit;

ii. substantially commence the development within 1 year after the date of settlement of the contract; and

iii. practically complete the development within 3 years after the date of settlement of the contract.

A person may make a written submission on the Proposal. Any person proposing to make a submission must do so by 5pm Friday, August 2, 2024.
