NOTICE OF INTENTION TO SELL LAND

Wodonga City Council (Council) gives notice under Section 114 of the Local Government Act 2020 (Act) that it intends to sell the land described below (Proposal).

The land which is the subject of the Proposal is an area of approximately 2.02 ha identified on the plan below, being part of Lot 15 on PS901711S and being part of the land in certificate of title volume 12541 folio 431, and located at part Roche Drive, Barnawartha North, Victoria 3691 (Land).

The Proposal is that the Land be sold by private treaty to Killen Trucking Company Pty Ltd and/or nominee, on the following key terms:

a. a purchase price of $1,400,000 (or $70/m²) plus GST;
b. payment of a deposit equal to 5% of the price;
c. settlement will be due on the later of six (6) months after the day of sale, thirty (30) days after the grant of the Permit and thirty (30) days after the registration of a plan of subdivision by the Registrar;
d. the sale will be conditional on the purchaser procuring a planning permit to develop the Land
as a transport depot (Permit), within 6 months after the day of sale; and
e. as a condition of sale, the purchaser must enter into an agreement with Council pursuant to section 173 of the Planning and Environment Act 1987, which requires the purchaser to:

i. develop the Land in accordance with the Permit;
ii. substantially commence the development within 1 year after the date of settlement of the contract; and
iii. practically complete the development within 2 years after the date of settlement of the contract.

A person may make a written submission on the Proposal. Any person proposing to make a submission must do so by 5pm Friday, August 9, 2024.
