Notice of Intention to Sell land

Wodonga City Council (Council) gives notice under Section 114 of the Local Government Act 2020 (Act) that it intends to sell the land described below (Proposal).

The land which is the subject of the Proposal is an area of 43.5 ha identified as “lot 4” on the plan below, being part of the land contained in certificates of title volume 12541 folios 431 and 433, and located at 141 Baxter-Whelans Road, Barnawartha North, Victoria 3691 (Land).

The Proposal is that the Land be sold by private treaty to Released Energy Pty Ltd and/or nominee, on the following key terms:

a. a purchase price of $21,500,000 plus GST;

b. payment of a deposit equal to 10% of the price;

c. settlement will be due 30 days after the later of the date of:

    • the purchaser’s planning permit;
    • registration of a plan of subdivision;
    • execution of a connection agreement between the purchaser and AusNet; and
    • provision by Council of services to the Land.

d. the sale will be conditional on the purchaser procuring a planning permit to use and develop the Land as a factory for the manufacture of energy storage systems, car parking, an energy storage system, aboveground water storage, a data centre and ancillary activities (Permit), within 12 months after the day of sale; and

e. as a condition of sale, the purchaser must enter into an agreement with Council pursuant to section 173 of the Planning and Environment Act 1987, which requires the purchaser to:

i. develop the Land in accordance with the Permit;

ii. substantially commence the development within 2 years after the date of settlement of the contract; and

iii. practically complete the development within 4 years after the date of settlement of the contract.

A person may make a written submission on the Proposal. Any person proposing to make a submission must do so by 5pm on Tuesday, September 10, 2024.
