Notice of intention to sell land

Council gives notice under section 114 of the Local Government Act 2020 that it intends to: (a) sell the land described below as Parcel 1; and (b) grant an option to purchase Parcel 2 and, if the option is exercised, to sell Parcel 2 to Casey Taylor Property Developments Pty Ltd.

For the purposes of this notice:

  • Parcel 1 is the land shown as Parcel 1 on the plan below being part of the land in certificates of title volume 12628 folio 771 and volume 12687 folio 483, being part of 109 Roche Drive, Barnawartha North.
  • Parcel 2 is the land shown as Parcel 2 on the plan below being part of the land in certificate of title volume 12628 folio 771, being part of 109 Roche Drive, Barnawartha North.


Parcel 1

The sale proposal is on the following key terms:

  • a purchase price of $3,366,700 plus GST;
  • payment of a deposit equal to 3.5% of the price;
  • settlement will be due 30 days after the later of:
    • the date of the purchaser’s planning permit; and
    • the date of registration of a plan of subdivision to create Parcel 1;
  • the sale will be conditional upon the purchaser procuring a planning permit for use and development of the Land as a furniture and warehousing distribution facility;
  • as a condition of the sale, the purchaser must enter into a section 173 agreement with Council pursuant to section 173 of the Planning and Environment Act 1987 on terms as required by Council; and
  • as a condition of the sale and subject to entering into a rate concession deed on terms as required by Council, Council agrees to provide a rate concession for the land.


Parcel 2

The option to purchase proposal is on the following key terms:

  • option period of 3 years;
  • option fee of $89,500.80 plus GST (non-refundable);
  • a purchase price of $4,475,040 plus GST
  • payment of a deposit equal to 3.5% of the price (option fee to be applied to deposit);
  • settlement will be due 30 days after the later of:
    • the date of the purchaser’s planning permit; and
    • the date of registration of a plan of subdivision to create Parcel 2;
  • the sale will be conditional upon the purchaser procuring a planning permit for an agreed purpose; and
  • as a condition of the sale, the purchaser must enter into a section 173 agreement with Council pursuant to section 173 of the Planning and Environment Act 1987 on terms as required by Council.


Making a submission

A person may make a written submission on the sale proposal within 21 days of the commencement of the consultation period.
